Throughout these Terms of Service, the terms “Streamzsports”, “we”, “us” and “our” refer to the operator named above, unless the product page or order confirmation clearly identifies another seller as the contract party.
These Terms of Service apply to the use of this website and online store, including all related information, content, features, tools, products and services made available through Streamzsports.
By visiting, interacting with or using our website, placing an order, booking an event entry, purchasing a service, subscribing to a support plan, or buying a physical product, you agree to be bound by these Terms of Service and by the policies referenced in them, including our Privacy Policy and Refund Policy.
If you do not agree to these Terms of Service, you should not use this website or place an order through Streamzsports.
2. Contract party for purchases
Streamzsports provides the online store and order process. Depending on the product or service selected, the purchase contract may be concluded either with Streamzsports or with another seller identified on the product page, during checkout, in the order confirmation, or in the customer order history.
Where another seller is identified, that seller is the contract party for the relevant product or service. Streamzsports may act as technical platform, entry platform, payment facilitator, organizer support provider, or service provider, depending on the specific product or event.
The identity and contact details of the applicable seller must be shown clearly before or at the time of purchase. Customers should review the product page and order confirmation carefully before completing their order.
Prices, availability, refund conditions and service conditions may vary depending on the selected product, event, seller, customer location, currency, or applicable tax treatment.
3. Relationship with Shopify
Streamzsports is powered by Shopify, which provides the e-commerce platform that enables us to offer the online store and related services.
However, purchases made through the store are made with the applicable seller identified under Section 2, and not with Shopify. Shopify is not responsible for the products, services, events, entries, bookings, subscriptions, physical goods, refunds, cancellations, or customer support provided by Streamzsports or by any other seller identified in the order process.
4. Access and account
You may be asked to provide information such as your name, e-mail address, billing address, payment information, rider information, event registration details, shipping information, or other information required to process your order.
You confirm that all information you provide is correct, current and complete, and that you have the right to provide this information.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity under your account. You may not transfer, sell, assign or license your account to another person without our written consent.
If you provide information for another person, including a rider, child, team member or family member, you confirm that you are authorized to do so.
5. Products and services
Streamzsports may offer different types of products and services, including but not limited to:
- BMX race entries and event registrations;
- camping bookings or related event services;
- livestream support subscriptions;
- one-off support payments or donations where offered;
- digital services;
- physical products or merchandise;
- timing, event or platform-related services.
Product and service descriptions are provided as accurately as reasonably possible. We may update, modify or discontinue products and services at any time, unless an order has already been accepted and the change would affect a binding customer right.
For event-related products, the product page, event information, organizer rules, refund policy and any applicable sporting regulations may contain additional conditions. These additional conditions form part of the contract where they are shown or referenced before purchase.
6. Orders and contract formation
When you place an order, you make an offer to purchase the selected product or service under these Terms of Service and any additional conditions shown during the order process.
A contract is concluded when the order is accepted by the applicable seller. Acceptance may occur through an order confirmation, payment confirmation, entry confirmation, booking confirmation, access activation, or other confirmation shown or sent electronically.
We may refuse, limit or cancel an order where reasonably necessary, including where:
- product or event availability is limited;
- payment cannot be processed;
- required information is missing or incorrect;
- the order appears fraudulent, abusive or technically incorrect;
- the selected product is not available to the customer;
- the order conflicts with event rules, category rules, organizer rules or legal requirements.
If an order is refused or cancelled after payment, the applicable seller will refund the amount owed under the Refund Policy or the specific product conditions.
Before placing an order, you are responsible for checking the product, quantity, rider details, event, category, date, price, billing details and any other order information.
7. Prices, taxes, currency and billing
Prices are shown in the currency displayed in the online store. Unless stated otherwise, the price shown at checkout is the total price charged by Streamzsports or the applicable seller for the selected product or service.
Where applicable, prices may include taxes, platform costs, payment processing costs, service costs or other costs. Where additional costs apply, they should be shown before the order is completed.
Prices, discounts, promotions and currency conversions may change without notice. The price charged will be the price shown at the time the order is placed and confirmed.
Depending on the customer location, currency settings, tax treatment, Shopify settings, payment provider, or seller setup, displayed prices may vary.
You agree to provide current, complete and accurate purchase, payment and account information. You confirm that you are authorized to use the selected payment method and that the payment information provided is true and complete.
8. Payment
Orders must be paid using one of the payment methods offered at checkout. Payment must be received and processed before an order can be accepted, unless a different arrangement is expressly offered.
If a payment is reversed, rejected, disputed or charged back, we may suspend or cancel the related order, booking, entry, subscription, service access or customer account, unless the issue is resolved.
For subscriptions, the billing interval, price and renewal conditions are shown before purchase. By purchasing a subscription, you authorize recurring charges according to the selected plan until the subscription is cancelled or otherwise terminated.
9. Delivery, event fulfilment and access
Delivery and fulfilment depend on the type of product or service ordered.
For digital services, event entries, bookings, subscriptions and livestream support products, fulfilment may occur by electronic confirmation, customer account update, entry list update, event registration, digital access, or another service action.
For physical goods, delivery times are estimates unless expressly guaranteed. We are not responsible for delays caused by carriers, customs, incorrect customer information, weather, force majeure events or other circumstances outside our reasonable control.
For physical goods, risk passes to the customer when the goods are handed over to the carrier, unless mandatory law provides otherwise.
10. Withdrawal, cancellation and refunds
Under Swiss law, customers do not have a general automatic right to withdraw from or cancel an online purchase simply because they changed their mind, unless such a right is expressly offered by the seller or required by mandatory law.
Streamzsports therefore does not grant a general right of withdrawal for all purchases.
Cancellation, withdrawal, refund or return rights depend on the product or service purchased and are governed by:
- these Terms of Service;
- the Refund Policy;
- the product page;
- the event page;
- the subscription conditions;
- the applicable seller conditions;
- any mandatory legal rights that cannot be excluded.
For event entries, race registrations, camping bookings, transponder rental options, timing services or other event-related services, cancellations and refunds are only available if expressly stated in the Refund Policy, on the product page, in the event conditions, or by the applicable organizer or seller.
For digital services, livestream support, subscriptions, access-based services or services that begin shortly after purchase, cancellation and refund rights may be limited once the service has started, access has been granted, or the event-related service has been reserved.
For physical goods, returns are only accepted according to the Refund Policy and any product-specific conditions.
If a voluntary withdrawal, cancellation or return right is offered for a specific product, the following must be clearly stated for that product or in the Refund Policy:
- whether a withdrawal or return right exists;
- the applicable deadline;
- the method for requesting withdrawal, cancellation or return;
- the condition in which goods must be returned;
- who bears return shipping costs;
- whether payment fees, service fees, entry fees, booking fees or processing costs are refundable;
- when and how refunds are made.
Refund requests must be sent to timing@streamzsports.com, unless the product page, order confirmation or Refund Policy identifies another contact address or seller contact.
11. Event entries, rider information and sporting rules
For race entries and event-related services, customers are responsible for entering correct rider, category, license, transponder, plate, club, country and contact information.
Streamzsports may use customer-provided information to validate entries, assign categories, prepare start lists, synchronize entries with third-party race management systems, process payments, communicate with organizers, or provide timing and event services.
Incorrect or incomplete information may result in entry rejection, category changes, manual correction, additional checks, delays, exclusion from a race, or loss of eligibility for a refund, depending on the applicable event rules.
Sporting decisions, category merges, race formats, race-day changes, safety decisions and event cancellations may be made by the event organizer, race director, commissaires, venue operator or competent sporting authority. Streamzsports is not responsible for such decisions unless Streamzsports is expressly acting in that role for the relevant event.
12. Subscriptions and support plans
Where Streamzsports offers subscriptions or support plans, the subscription conditions shown at the time of purchase apply.
Subscriptions renew automatically according to the selected billing interval until cancelled. Customers are responsible for cancelling subscriptions before the next billing date if they no longer wish to continue.
Unless otherwise stated, amounts already charged for a subscription period are not refunded solely because the customer cancels during that period.
Support subscriptions help finance services such as livestreaming or event support, but they do not guarantee that every event will be streamed, that a stream will be uninterrupted, or that a specific event will be covered, unless this is expressly promised in writing.
13. Accuracy of information
We aim to keep the information on the website accurate, complete and current. However, mistakes, outdated information, technical errors or omissions may occur.
We reserve the right to correct errors, update information, change prices, cancel orders, or modify product descriptions where legally permitted, including after an order has been submitted, if the information shown was incorrect.
Historical event information, past results, archived product information, prior livestream information or old event pages may be provided for reference only and may no longer be current.
14. Optional tools and third-party services
We may provide access to third-party tools, platforms, payment providers, race management systems, video platforms, maps, embedded content or other services.
These third-party services are provided by their respective providers and may be subject to separate terms and privacy policies. We do not control and are not responsible for third-party services unless mandatory law provides otherwise.
Use of third-party tools is at your own risk and discretion.
15. Third-party links
Our website may contain links to third-party websites or embedded third-party content. We are not responsible for examining, evaluating or guaranteeing the accuracy, legality, availability or content of third-party websites or services.
If you leave our website or interact with third-party content, you do so at your own risk.
16. Intellectual property
The website, Streamzsports name, logo, design elements, text, images, graphics, video, audio, layouts, software elements and other content are owned by Streamzsports, its licensors, suppliers, partners or other rights holders, unless stated otherwise.
You may use the website for personal, lawful and non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, commercially exploit, scrape, copy, republish, download, store or transmit website content without prior written consent, unless permitted by law.
Shopify’s name, logos and service names are trademarks of Shopify. Other names, logos, event names, club logos, product names and trademarks remain the property of their respective owners.
17. Privacy
Personal information collected through Streamzsports is handled according to our Privacy Policy: https://streamzsports.com/policies/privacy-policy.
Because the store is powered by Shopify, certain personal information may also be processed by Shopify and by third-party service providers involved in hosting, payment processing, analytics, fulfilment, communication, race management or other services.
By using the website and placing orders, you acknowledge that personal information may be processed as described in the Privacy Policy.
18. Feedback, comments and submissions
If you send us feedback, suggestions, ideas, reviews, comments, proposals, media, images, race-related content or other submissions, you confirm that you have the right to do so.
Unless otherwise agreed in writing, you grant Streamzsports a non-exclusive, worldwide, royalty-free right to use, reproduce, modify, publish, translate, display and distribute such feedback or submissions for the purpose of operating, improving, promoting and providing the website, store and services.
We are not required to keep feedback confidential, pay compensation for feedback, or respond to feedback.
You may not submit unlawful, abusive, misleading, defamatory, obscene, infringing, malicious or harmful content.
19. Prohibited uses
You may not use the website, store or services:
- for unlawful, fraudulent or malicious purposes;
- to violate applicable laws, regulations, sporting rules or third-party rights;
- to submit false or misleading information;
- to harass, abuse, threaten, defame, discriminate against or harm another person;
- to upload or transmit viruses, malware or harmful code;
- to interfere with or bypass security features;
- to scrape, copy, extract, resell or exploit website content or customer information;
- to spam, phish, pretext or send unauthorized promotional material;
- to impersonate another person or entity;
- to interfere with the proper operation of the website, store, event services or third-party systems.
We may suspend, restrict or terminate access to the website, store, account, order, booking, subscription or service if we reasonably believe that these Terms have been violated.
20. Automated access and agents
No automated tool, bot, scraper, crawler, agentic AI system or similar system may access, use, interact with, copy, extract or place orders through the website unless expressly permitted by us or technically allowed under conditions we define.
Where automated access is permitted, the tool must identify itself truthfully and must not bypass technical restrictions, CAPTCHAs, rate limits, robot exclusion measures, authentication systems or other access controls.
We may restrict or block automated access at any time.
21. Disclaimer of warranties
The website and services are provided on an “as is” and “as available” basis, unless expressly stated otherwise.
We do not guarantee that the website, store, payment process, livestreams, digital services, event integrations, third-party systems or other services will be uninterrupted, error-free, secure, available at all times, or free from technical issues.
Nothing in these Terms excludes warranties, rights or remedies that cannot be excluded under mandatory law.
22. Limitation of liability
To the fullest extent permitted by law, Streamzsports and the applicable seller are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profit, loss of revenue, loss of data, lost opportunity, reputational harm, replacement costs, or similar damages arising from the use of the website, store, products or services.
For event-related services, Streamzsports is not liable for decisions, cancellations, delays, rule changes, race schedule changes, category changes, weather conditions, venue restrictions, organizer decisions, sporting decisions, third-party system failures or force majeure events, unless Streamzsports is legally responsible for the relevant event or damage under mandatory law.
Liability for intent, gross negligence, personal injury, mandatory statutory liability and rights that cannot be excluded remains unaffected.
23. Indemnification
You agree to indemnify and hold harmless Streamzsports, the applicable seller, Shopify, and their respective partners, officers, employees, contractors, service providers and licensors from claims, losses, damages, liabilities and reasonable costs arising from:
- your breach of these Terms;
- your violation of applicable law or third-party rights;
- incorrect, unauthorized or misleading information you provide;
- your misuse of the website, store, products or services.
This applies only to the extent permitted by applicable law.
24. Termination
We may suspend or terminate access to the website, store, services, account, subscription or order where reasonably necessary, including where you breach these Terms or misuse the services.
Termination does not affect obligations or liabilities that arose before termination.
Sections that by their nature should survive termination remain in effect, including intellectual property, payment obligations, disclaimers, liability limitations, indemnification, privacy, governing law and jurisdiction.
25. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions remain valid and enforceable. The invalid provision will be interpreted or replaced, to the extent legally possible, by a valid provision that comes closest to the original purpose.
26. Waiver and entire agreement
Failure to enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
These Terms, together with the policies and product-specific conditions referenced in them, form the agreement between you and Streamzsports or the applicable seller for the use of the website and purchase of products or services.
27. Assignment
You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations where reasonably necessary for business operations, legal restructuring, sale of business, platform operation, or service continuity, provided this does not unlawfully reduce your mandatory consumer rights.
28. Governing law and place of jurisdiction
These Terms of Service and any contracts concluded through Streamzsports are governed by the substantive laws of Switzerland, excluding conflict-of-law rules, unless mandatory law provides otherwise.
For business customers, and to the extent legally permitted for consumers, the exclusive place of jurisdiction is Zürich, Switzerland.
Mandatory places of jurisdiction for consumers remain reserved. Nothing in these Terms limits a consumer’s right to bring claims before a court that has mandatory jurisdiction under applicable law.
Where the contract is concluded with another seller identified under Section 2, the applicable seller’s registered seat or domicile may determine the place of jurisdiction, unless the product page, order confirmation or seller terms clearly state another legally valid place of jurisdiction.
29. Changes to these Terms
We may update, change or replace these Terms of Service from time to time by publishing the updated version on the website.
The version applicable to a specific order is generally the version available at the time the order was placed, unless mandatory law or the specific product conditions provide otherwise.
For ongoing services or subscriptions, material changes will apply after notice has been provided where legally required. Continued use of the services after changes become effective constitutes acceptance of the updated Terms, unless mandatory law provides otherwise.
